Welcome to Smart ~ Handcrafted Creations. These Terms and Conditions ("Terms") govern your use of our website and your purchase of handcrafted and personalized products from us. By placing an order, you agree to these Terms.
1. About Our Products
All items are handmade and/or personalized to order. Because each piece is made by hand:
- Slight variations in color, texture, size, and finish are normal and expected. No two handmade items are perfectly identical — this is part of their charm, not a defect.
- Photos are a close representation but may differ slightly from the finished product due to monitor settings, lighting, and the natural variation in materials.
2. Personalization & Customization
- Accuracy is your responsibility. You must carefully check all names, dates, initials, spelling, and other custom details before submitting your order. Once production begins, we are not responsible for errors that match exactly what you submitted.
- Proof approval (if offered). For complex customizations, we may send a digital proof for your approval before production. Production will not begin until you approve it. Please respond promptly, as delays in approval will delay your order.
- Changes after order placement. Once an order enters production, changes or cancellations may not be possible.
- Content restrictions. We reserve the right to refuse any personalization request that is offensive, infringes on copyright/trademark, or that we are otherwise uncomfortable producing.
3. Order Processing & Production Time
- Estimated production time: 5–7 business days, not including shipping time. This will be clearly stated on each product listing.
- Production time begins after payment is confirmed (and proof approval, if applicable) — not on the date the order is placed.
- During peak seasons (e.g., holidays), processing times may be longer. We'll note this on our site/listings when relevant.
4. Shipping
- Shipping costs and estimated delivery times vary by destination.
- We are not responsible for delays caused by the shipping carrier once a package leaves our hands.
- Please double-check your shipping address before submitting your order. We are not responsible for items lost or delivered incorrectly due to an incorrect address provided by the customer. If a package is returned to us due to an incorrect address, reshipping costs are the customer's responsibility.
- Risk of loss and title for items pass to you upon our delivery to the shipping carrier.
5. Returns, Exchanges & Cancellations
Because most items are made specifically for you:
- Personalized items are final sale and cannot be returned or exchanged or refunded unless they arrive damaged, defective, or significantly different from what was ordered.
6. Damaged, Defective, or Incorrect Items
If your item arrives damaged, defective, or different from what you ordered:
- Contact us within 24 hours of delivery
- Include photos of the item and packaging.
- We will offer a replacement, repair, or refund, at our discretion, once the issue is verified.
This policy does not cover normal wear and tear, damage from misuse, or the natural material variations described in Section 1.
7. Pricing & Payment
- All prices are listed in KWD and are subject to change without notice (changes will not affect orders already placed).
- Full payment is required at the time of order unless otherwise stated.
8. Intellectual Property
- All designs, photos, branding, are the property of Smart ~ Handcrafted Creations and may not be copied, reproduced, or used without written permission.
- By submitting text, images, or other content for personalization, you confirm you have the right to use it and grant us permission to use it solely to produce your order.
9. Social Media & Photography
We love sharing our work! We may photograph your order to feature on our social media, website, or portfolio. To protect your privacy:
- We will only post photos of your personalized item after receiving your approval.
- If you do not approve, or if we are unable to reach you for approval, any photos we share will have personal details (such as names, dates, initials, or other identifying text) blurred or censored.
- If you'd prefer we don't feature your item at all, just let us know and we'll leave it out entirely.
10. Limitation of Liability
Smart ~ Handcrafted Creations is not liable for any indirect, incidental, or consequential damages arising from the use of our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.
11. Care Instructions
Handmade items may require special care. Please follow any care instructions included with your order. Damage resulting from improper care, cleaning, or use is not covered under our defect policy.
12. Privacy
Information collected during checkout (name, address, contact details) is used only to process and fulfill your order, and is handled accordingly. For more detail, see our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place an order is the one that applies to that order.
